Wills and Gifts: When a Lineage Record Becomes Proof of Heirship

Short Answer

A will and a lifetime gift each settle part of an estate before faraid is calculated, but both still require an accurate list of heirs. A complete, sourced lineage record shortens the process at the Syariah Court, because an inheritance dispute almost always begins as a dispute over who the heirs are.

Most inheritance disputes in a family do not begin as arguments about money. They begin as arguments about who the heirs are.

Three different instruments

  • Wasiat (a will) โ€” instructions that take effect after death, limited to one third of the estate, and not available to an heir who already receives a faraid share (except with the consent of the other heirs).
  • Hibah (a lifetime gift) โ€” given during life, taking effect immediately once delivered and accepted. Because it happens before death, gifted property is no longer part of the estate.
  • Faraid โ€” the division of what remains, according to the shares fixed by syarak.

The three work in order: debts and funeral expenses first, then the will up to one third, then the remainder divided by faraid. Property validly given as hibah never enters that order at all.

Why the lineage record matters here

Each of the three instruments needs a complete and accurate list of heirs:

  1. A will in favour of an heir requires the consent of the other heirs โ€” so you need to know who all the heirs are
  2. A gift that excludes an heir is often challenged; a clear record of who the heirs are makes it easier for the authorities to assess
  3. Faraid cannot be calculated at all without a final list of heirs

A missed heir โ€” a maternal half-sibling, a child from an earlier marriage, or a grandchild standing in for a child who died first โ€” is the most common cause of delay in an estate case.

Documents to keep alongside the family tree

  • Birth certificates and marriage certificates for every generation
  • Death certificates, not just the dates
  • Land titles and ownership documents
  • Wills and witnessed gift documents
  • Faraid Certificates from earlier estate cases in the family

A Faraid Certificate from an old case is especially useful: it is an official confirmation of who the heirs were at a point in time, and it saves verification work on the next case.
